Terms of Use
1. General Provisions
1.1. These Terms set out the conditions under which Users (Customers) may use the materials and services of the website tunes.ua (the "Site," "website," "online store").
1.2. In accordance with Articles 633, 641 and Chapter 63 of the Civil Code of Ukraine, these Terms constitute a public contract (offer) addressed to an unlimited number of persons, regardless of status (individual, legal entity, or sole proprietor), who wish to purchase goods from the online store tunes.ua, operated by Sole Proprietor Yurii Andriyovych Shevchenko (address: 15 Dobrovolskoho St., Horishni Plavni, Poltava Oblast, 39800, Ukraine).
1.3. Since these Terms constitute a public offer, a User (Customer) who accesses the Site's materials is considered to have accepted these Terms.
1.4. The Site Administration (the owner of tunes.ua and/or its authorized representatives) reserves the right to unilaterally amend these Terms at any time. A new or amended version takes effect once published on the Site. If a User disagrees with the changes, they must stop accessing the Site and using its materials and services.
1.5. The Customer agrees to this public offer in full and without reservation by placing an Order on the Site.
1.6. The Visitor (Customer) confirms that all terms of this Agreement are understood and are accepted fully and unconditionally.
2. Site Registration
2.1. To place Orders on the Site, the User (Customer) may complete a registration process and provide the required information via the registration form.
2.2. When registering on the Site, the User (Customer) agrees to provide accurate and truthful personal and contact information, so the Site Administration can fulfill its obligations to the User (Customer) and deliver the paid-for Goods.
2.3. During registration, the User (Customer) sets a login (their email address) and password, and is responsible for keeping them secure. The User (Customer) agrees not to share their login and password with third parties and to store them somewhere inaccessible to others. The Customer bears sole responsibility for any actions taken under their account, i.e. using their login and password.
3. Confidentiality and Personal Data
3.1. Information provided by the User (Customer) is confidential. The Site Administration uses information about the User (Customer) to fulfill the Visitor's (Customer's) Orders, unless another purpose is specified in these Terms.
3.2. By completing the registration form on tunes.ua, the Visitor (Customer) voluntarily consents to the collection and processing of their personal data by the Site Administration for the following purposes: the data provided during registration will be used to process Orders for Goods, to provide order information, and to send — via electronic communication channels (email, mobile communication) — promotional and special offers, information about sales, giveaways, or any other information about the activities of the tunes.ua website, and for other commercial purposes.
3.3. For the purposes described in this section, the Administration may send letters, notifications, and materials to the Visitor's (Customer's) postal address and email, as well as send SMS messages and make calls to the phone number provided in the registration form, where necessary to fulfill the User's (Customer's) order. The Administration may record phone calls with the Visitor (Customer) to improve service quality, to which the Visitor (Customer) gives unconditional consent.
3.4. The Visitor (Customer) consents to the Administration's use of cookie technology. Cookies do not contain personal information and cannot read information from the Visitor's (Customer's) hard drive in any way. Cookies are used to improve the quality of services provided, including: quickly identifying the Visitor (Customer); saving the Visitor's (Customer's) settings and personal preferences; and tracking the Visitor's (Customer's) session status and behavior patterns. The Administration also uses cookies for advertising purposes, including managing advertisements across websites on the internet. If the Visitor (Customer) disables cookies, the Administration cannot guarantee full functionality of the tunes.ua website or some of its services.
3.5. If the Visitor (Customer) does not wish to receive marketing communications about promotions, new products, etc., they may opt out by sending a message to the Administration and/or by adjusting the relevant setting in their personal account.
3.6. The Administration is not responsible for the content or accuracy of information provided by the Visitor (Customer) during registration on tunes.ua or when placing an Order. The Visitor (Customer) is responsible for the accuracy of the information provided during registration and when placing an Order, and accepts all risks associated with any inaccuracy of such information.
4. Order Procedure, Pricing, and Exchange
4.1. The Visitor (Customer) may place an order independently, by clicking "Buy" and "Place Order," or by phone using the number shown at the top of the page. Once the order is placed, the Customer will receive a confirmation message, sent to the contact details provided when ordering, regarding product availability or the expected date of arrival if the product is currently out of stock. For orders placed by phone, confirmation is provided by phone.
4.2. If a product listed on the Site is unavailable due to technical issues or other reasons beyond the Administration's control, the relevant order will be cancelled in full or in part, and the Visitor (Customer) will be notified accordingly.
4.3. By accepting these Terms and placing an order, the User (Customer) confirms that they have reviewed the Site's "Shipping and Payment" and "About Us" sections, agree to them, and fully understand them. The Administration reserves the right to change the delivery timeframe for an order, with corresponding notice to the User.
4.4. The Visitor (Customer) agrees that the price, assortment, and quantity of goods added to their "cart" are valid only at the moment the cart is created and may change if the purchase is not finalized by clicking "Place Order" / "Buy."
4.5. The Visitor (Customer) agrees that purchased Goods are not eligible for exchange or return in the following cases:
4.5.1. More than 14 calendar days have passed since the purchase.
4.5.2. Fewer than 14 calendar days have passed since the purchase, but the product has been used, the packaging integrity and/or completeness has been compromised, tags/price stickers are missing, etc.
4.5.3. The product is included in the list of goods that are not subject to return or exchange under Resolution No. 172 of the Cabinet of Ministers of Ukraine, dated March 19, 1994 (as currently in force), available at http://zakon4.rada.gov.ua/laws/show/172-94-%D0%BF, specifically:
Food products, medicines and medical supplies, personal hygiene items.
Non-food products:
Photographic film, photographic plates, photographic paper.
Corsetry.
Perfume and cosmetic products.
Down and feather products.
Soft children's toys.
Inflatable rubber children's toys.
Toothbrushes.
Mouthpieces.
Shaving devices.
Shaving brushes.
Combs and massage brushes.
Mutes (for wind instruments).
Violin chinrests.
Gloves.
Fabrics.
Tulle-curtain and lace fabrics.
Carpet products sold by length.
Underwear.
Bed linen.
Hosiery.
Aerosol-packaged goods.
Printed publications.
Linear and sheet rolled metal, pipe products, lumber, molding products (baseboards, trim), board materials (fiberboard and particleboard, plywood) and glass cut to a size specified by the buyer (customer).
Audio and video cassettes, discs for laser reading systems, with recordings.
Products made from natural or synthetic hair (wigs).
Products for infants (receiving blankets, pacifiers, feeding bottles, etc.).
Manicure and pedicure tools (scissors, files, etc.).
Jewelry made from precious metals, precious stones, organogenic precious stones, and semi-precious stones.
4.5.4. The Visitor (Customer) refuses to provide photographs of the allegedly defective and/or faulty product.
4.6. By these Terms, the User (Customer) confirms they understand that only new, unused products with no signs of use (scratches, chips, wear) are eligible for exchange or return. The following must be intact: the complete product set, packaging integrity and all its components, tags, factory markings, and the Visitor (Customer) must have the original document confirming the purchase of the relevant Goods. A breach of any of these conditions gives the Administration the right to refuse an exchange or return.
4.8. If the Visitor (Customer) returns a product, the Administration will refund the amount paid by the Customer, minus the Seller's cost of return shipping from the Customer.
5. Limitation of the Administration's Liability
5.1. The Administration is not responsible for any errors, typos, or inaccuracies that may be found in the materials on this website. The Administration makes every reasonable effort to ensure the accuracy and reliability of the information on the online store's website. All information and materials are provided "as is," without any warranties, express or implied.
5.2. The Administration is not responsible for the statements or opinions of website Visitors (Customers) left as comments or reviews.
5.3. The Administration is not liable for any unlawful actions of a Visitor (Customer) toward third parties, or of third parties toward the Visitor/Customer.
5.4. The Administration is not liable for any damage, losses, or costs (actual or potential) arising in connection with this website, its use, or the inability to use it.
5.5. The Administration is not responsible for a User (Customer) losing access to their account on tunes.ua (loss of login, password, or other information).
5.6. For the purposes described above, the Administration reserves the right to remove information posted on the Site and to take technical and legal measures to restrict access to the online store for Users (Customers) who cause problems for other Visitors (Customers) using the online store, or who violate the requirements of these Terms.
5.7. The website Administration, among other things, is not responsible for:
5.7.1. Delays or failures in the course of a transaction resulting from force majeure, or any failure in telecommunications, computer, electrical, or other related systems.
5.7.2. The actions of transfer systems, banks, or payment systems due to delays in their operation.
5.7.3. The proper functioning of the Site if the Visitor (Customer) lacks the necessary technical means to use it, and bears no obligation to provide users with such means.
6. Exclusive Rights
6.1. All objects accessible through the services of the tunes.ua website, including design elements, text, graphic images, illustrations, video, computer programs, databases, music, sounds, and other objects (collectively, "service content"), as well as any content posted on the tunes.ua website, are subject to the exclusive rights of the Administration and other rights holders.
6.2. Content, as well as any other elements of the services, may only be used within the functionality offered by the relevant service. No elements of the content of tunes.ua's services, nor any content posted on tunes.ua's services, may be used in any other way without the prior permission/consent of the rights holder. "Use" includes, among other things: reproduction, copying, modification, distribution on any basis, and display in a giveaway, etc. Exceptions apply only in cases expressly provided for by the legislation of Ukraine. Use by a User of service content elements, or any content, for personal, non-commercial purposes is permitted provided that all copyright and related-rights notices, trademarks, and other attribution notices are preserved, the name (or pseudonym) of the author/name of the rights holder remains unchanged, and the relevant object is preserved unchanged. Exceptions apply only in cases expressly provided for by the legislation of Ukraine.
